1. By way of the present petition filed under Section 482 Cr.PC., petitioner seeks directions thereby quashing of FIR No.495/14 registered at Police Station South Campus, District South Delhi for the offences punishable under Sections 336/304-A IPC.

2. Learned counsel appearing on behalf of the petitioner submits that the aforesaid case was registered on the complaint of SI Sri Bhagwan vide DD no. 21-A pursuant to an incident took place on 04.12.2014, in which Mohd. Saheb Ali, husband of respondent no.2 died and respondent nos.[7] and 8 received injuries. Thereafter, petitioner and respondents entered into an agreement dated 01.01.2015 whereby the petitioner agreed to pay an amount of Rs. 10,45,000/- in favour of the respondent nos.[2] to 6 and amount of Rs. 40,000/- each in favour of the respondent no. 7 and 8. The 2015:DHC:9692 Crl.M.C. No.3920 /2015 petitioner has already paid an amount of Rs.3,10,000/- in cash to the widow and parents of the deceased and Rs.10,000/- each in favour of the respondent no.7 and 8 injured and out of the remaining amount, petitioner has made the payment today as under:

7. Keeping in view the settlement arrived at between the parties, statement of respondent no.2 and 5 to 8 and ld. APP for the State and the settled legal position, FIR No.495/14 registered at Police Station South Campus, District South Delhi for the offences punishable under Sections 336/304-A IPC with emanating proceedings therefrom are hereby quashed against the petitioner.

8. Accordingly, the petition is allowed.
