23.11.2015 2015:DHC:11111 Petitioners before this Court are Raju Porwal, ManMohan Singh and Rakesh. They are seeking parole for the purpose of filing SLP against dismissal of their appeal which has been dismissed by this
Court on 28.05.2015.
The nominal rolls of the petitioners have been requisitioned.
They are convicts under sections 376(2)(g) readwith section 328 ofthe
IPC and sentence oflife has been imposed on all ofthem. They have all suffered incarceration of more than TA years each. Each of them had availed interim bail earlier also and have since surrendered. Their jail conduct is satisfactory.
Noting the above factual matrix, this Court grants parole to the present petitioners for a period of three weeks (to be counted fi-om the date of their release) on their fiimishing a personal bond in the sum of
Rs.15,000/- each with one surety each of like amount subject to the satisfaction ofthe Jail Superintendant with condition that the petitioners shall appear before the local SHO on every Monday ofthe week in the intervening period ofparole. They shall given their mobile numbers to the SHO for contact purpose. Needless to state that they shall sunrender to the Jail Authorities on expiry ofthe period ofthree weeks.
It is made clear that the parole period ofeiach ofthem will start after the period ofthe other has expired. This Court notes that Rakesh is the first person to file the present petition and accordingly he is granted benefit ofparole in the first instance. Afterthe expiry ofhis three week penod the second petrtioner Raju Porwal shall be considered for paroie and thereafter Man Mohan Singh, This is in accordance with the date of their filing ofthe presentpetitions.
No further orders are called for.
