Vikash Sharma v. South Delhi Municipal Corporation and Anr

1. This public interest petition has been filed with a prayer to direct the respondents to stop the alleged illegal and unauthorized constructions made at H.N0.266-G, Ward No.2, Bhuiyan Chowk, Mehrauli, New Delhi and to ensure that no further illegal and unauthorized constructions take place in the said property. ^ 2. The respondent No.l/South Delhi Municipal Corporation filed a status report by way of short affidavit sworn by Shri Arun Kumar, Ex. Engineer (Civil), South Zone, SDMC stating that in order to ascertain the factual position the site has been inspected by the concerned area Junior Engineer (Building) and having found two buildings existing over the said property, action under Section 343/344 of the Delhi Mimicipal Corporation Act, 1957 has been initiated and that orders of demolition have also been 2016:DHC:9177-DB passed after following due process of law. It is further stated that letters for disconnection of electricity and water supply have also been sent to the concernedauthoritiesand the Sub-Registrar was requestednot to register the said property. That apart, action under Section 345-Aofthe DMC Act for sealing both the structures has also been initiated.

In view ofwhat has been stated in the short affidavit filed on behalfof the Corporation which reflects that steps have already been initiated in terms ofthe provisions ofthe DMC Act, 1957 in respect ofthe constructions over the propertyin question, it is not necessary to keep this petitionpendingany longer.
