Nos.26/2016 & 31/2016 The present two appHcations have been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.0970/2015, under Sections 186/353/332/34 IPC, Police Station Vasant Kunj. Arguments advanced by the learned counsel for the petitioners are that there was hot exchange of words in the Indian BankATM at the time of withdrawal of money, as a result of which a scuffle took place between the accused persons and the complainant and by the virtue of the same, the present case has been registered. He has further submitted that interim protection was granted to the petitioners by the Court of Sessions and they accordingly joined the investigation. Learned Additional Public Prosecutor for the State on the instructions of the Investigating Officer has submitted that the accused persons/petitioners are not required for the purpose ofarrest or custodial interrogation. In the facts and circumstances, it is hereby ordered that in the event of arrest of the accused persons/petitioners, namely, Rajeev Upadhyay and Manoj Upadhyay, they shall be released on bail on furnishing the personal bond in the sum of Rs.20,000/- with one surety in the Hke amount to the satisfaction ofthe arresting officer. The petitioners are directed to join the investigation as and when required. They shall not leave the country without prior permission of the concerned Court. They are also directed not to tamper with the evidence or influence theprosecution witnesses. Both the applications bearing Bail Appln. Nos.26/2016 & 31/2016 are disposed ofaccordingly.
