11.01.2016 The learned counsel for the appellants states that the parties have settled and a
Settlement Deed was executed on 29.12.2015. A copy of the said Settlement Deed has been handed over to us. The same is taken on record. In terms of the Settlement Deed, the appellants are required to inter a/ia unconditionally withdraw the present two appeals.
The respondent is also to unconditionally withdraw two suits from which these appeals arise, namely, CS (OS) No. 650/2009 and CS (OS) No. 660/2009. It is, however, to be noted that insofar as the CS (05) 660/2009 is concerned, the suit will be withdrawn only to the extent of any reliefs claimed against the present appellants. There is another defendant in that suit and the respondent who is the plaintiff therein may continue the suit against the other defendant. We are not specifying the other terms of the Settlement
' Deed as the same are elaborately set out therein and have been taken on record. The parties are bound by the Settlement Deed.
In view of these circumstances, the present appeals stand dismissed as withdrawn.
