JUDGMENT
(ORAL)

1. In furtherance of last order, status report was not filed but learned APP assisted by SHO/Inspector Nirbhay Kumar having examined the State Crime Records Bureau (SCRB) records submits that prior to the theft alleged in the present case, the accused/applicant was involved in three more theft cases, but they could not find out the details of the allegedly stolen articles. However, it is the admitted position that the accused/applicant is on bail in all those cases.

2. The accused/applicant seeks regular bail in case e-FIR No.2348/2024 of PS Lajpat Nagar for offences under Section 305(b)/317(2)/345(3)/3(5) BNS on the allegation that he stole away a car bearing No.RJ-34-CA-2036.

KATHPALIA Date: 2025.05.16 17:52:26 +05'30' BAIL APPLN.1719/2025 pages The e-FIR was registered on the complaint of the registered owner of the said car, alleging that the same was stolen from the front of the House No.A- 99, New Delhi (sic.) between 11:00pm and 09:00 am on 11.08.2024. In the course of investigation, on the basis of secret information, the investigating team zeroed down on the accused/applicant and apprehended him, after which at his instance, the stolen car was recovered.

3. Chargesheet has already been filed after completion of the investigation. In view of the comparative status of the complainant de facto (a judicial officer) and the accused/applicant, there is no apprehension of the latter trying to influence the former during trial.

4. Considering the above circumstances, the application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the learned trial court.

5. Copy of this order be sent to the concerned Jail Superintendent for informing the accused/applicant.
