No.750/2015 (P.S. Sagarpur) instituted for offences under Sections 452, 323, 506 and 34 of the IPG. Sections 379 and 458 of the IPC were added later.
The petitioner is alleged to have assaulted the complainant with fists, blows and legs along with other co-accused persons. It has been submitted that two of the co-accused persons with similar allegations have been enlarged on anticipatory bail while some ofthe accused persons have been granted regular bail.
Issue notice. Ms. Alpana Pandey, APP accepts notice. Status report be filed on or before the next date fixed.
Till the next date of hearing, no coercive steps shall be taken against the petitioner. The petitioner shall join investigation and would visit the
Police Station as and when required bythelO/SHO of the concerned Police

1. By way ofthese two applications filed under Section 438 Cr.P.C., the petitioners Vijay Kumar and Rahul Kumar are seeking anticipatory bail in BailAppl.Nos.2189 &2286 of2015 Page 1of[2] case FIRNo.750/2015 under Sections 452/323/506/34 IPG, PS Sagar Pur.

3. Learned APP for the State submits that the petitioners have joined and have also co-operated in the investigation. Learned APP for the State further submits that chargehseet against these two petitioners shall be filed shortly.

4. Considering the facts and circumstances of the case and the submissions made on behalf of the State that the petitioners have joined investigation and chargesheet against them shall be filed shortly, it is directed that in the event of arrest, the petitioners namely Vijay Kumar and Rahul Kumar be released on bail on their each furnishing personal bond in the sum of ?20,000/- with one surety each of the like amount to the satisfaction of lO/SHO concerned. However, the petitioners are directed to join the investigationas and when required by the lO/SHO concerned.

5. Both the applications stand disposed of. As prayed, copy of the order be given dasti to learned counsel for the parties.
