05.02.2016 These are the applications under Section 438 of Cr.PC moved by the petitioners seeking grant of anticipatory bail in case FIR No. 1036/2015 under Section 354/354-
B/376/323/34IPC & 4/12Pocso Actregistered at Police Station Shahbad Dairy.
Counsel for the petitioners submits that the petitioners have joined the investigation which fact is not disputed by the learned Additional Public Prosecutor for the State.
On instructions from the Investigating Officer, learned Additional Public
Prosecutor for the State further submits that custodial interrogation of the petitioners is not required in this case.
2016:DHC:8203 / Under the circumstances, it is orderedthat inthe event of their arrest:-
(i) Petitioners be admitted to bail on their executing personal bond in the sum of
Rs.15,000/- (Rupees Fifteen Thousand only) each with one surety in like amount to the satisfaction ofthe concerned I.O./SHO.
(ii) They shall jointheinvestigation asand when summoned bytheI.O.
(iii) They shall furnish their address as well as contact number to the Investigating
Officer.
(iv) They shall not contact the prosecutrix/complainant or any of the prosecution witnesses and will not threaten or coerce the complainant or any prosecution witness.
The applications are accordingly disposed of.
Copy ofthis order be given dasti to counsel for the petitioners.
