01.02.2016 Present are applications under Section 438 Cr.P.C seeking anticipatory bail in FIR No. 1242/2014, under Sections 420/406/34 IPG, registered at Police Station-Khajuri Khas. Ms. Radhika Kolluru, learned
APP appearing on behalf of the police states that the prime accused in the subject matter namely Mr. Ravi Dikshit and Ms. Sarita Dikshit as well as co- accused Mr. Ajit have already been enlarged on bail and have since joined investigation. The above statement has been made on instructions from the
10 in the subject FIR namely SI Mehrab Alam, Police Station-Kliajuri Khas.
Learned counsel appearing on behalf of the applicant in the respective bail applications invites my attention to the orders passed by this Court on the 07"^ January, 2016 as well as 20"' January, 2016 in this behalf. Counsel appearing on behalf of the applicants would urge that the present applicants are entitled to parity and undertake to join investigation by making themselves available to the 10 in the subject FIR as and when called upon by the latter to do so.
2016:DHC:8374 In view of the foregoing and by extending the principle of parity to the present applicants as has been granted to the other accused in the subject
FIR, the present application is allowed.
It is directed that in the event of their arrest the applicants shall be released on bail on their furnishing personal bond in the sum of 20,000/- each (Rupees Twenty Thousand) with one surety each ofthe like amount to the satisfaction of the Arresting Officer/Station House Incharge subject to the further conditions
. (i) the applicants shall join investigation and make themselves available for interrogation as and when called upon to do by the investigating officer;
(ii) the applicants shall not leave the National Capital Territory of
Delhi without the previous permission ofthis court.
Needless to state, in the event the applicants tamper with the evidence or try to influence witnesses, the State shall be at liberty to seek cancellation of bail of applicants.
With the above directions, the applications are disposed of.
