JUDGMENT
1. The accused/applicant seeks anticipatory bail in case E-FIR No.80039019/2025 for offence under Section 305 BNS registered at PS Swaroop Nagar. Broadly speaking the allegation against the accused/ applicant is that he committed theft of Rs.5,30,000/-. It appears that the accused/applicant and his mother also gave an interview to a channel on Youtube.
2. Against the above backdrop, learned APP after examining the investigation file and discussing with the Investigating Officer HC Anil KATHPALIA Date: 2025.05.19 18:51:44 +05'30' BAIL APPLN.1912/2025 pages Kumar submits that they have no objection to grant of anticipatory bail provided the accused/applicant joins investigation and hands over his mobile phone for examination. Learned counsel for accused/applicant is not averse to this.
3. Considering the above circumstances, the application is allowed and it is directed that in the event of his arrest, the accused/applicant be released on bail subject to his furnishing personal bond in the sum of Rs. 10,000/with one surety in the like amount to the satisfaction of the Investigating Officer/SHO. The accused/applicant shall join investigation as and when directed by the Investigating Officer in writing. The accused/applicant shall handover his mobile phone to the Investigating Officer as and when directed by him. It is also directed that in his notice calling upon the accused/applicant to join investigation, the Investigating Officer shall specify the time during which the accused/applicant is required to appear before him.
