15.02.2016 After some arguments,it has been agreed by the parties thatthe matter be remanded back to the Court of Additional Rent Controller
(ARC) who shall pass orders afresh on the petition filed by the landlord(UpperIndia Rubbers Works)as to whether the decree under
Section 14(l)(a)ofthe DRCA was called for or not. This Court has been informed that the evidence had already been completed before the Trial Judge and on the basis ofthe evidence already led before the
2016:DHC:8550 y- ARC,both oral and documentary, a fresh order will be passed by the
ARC uninfluenced by any orders made by the Rent Control Tribunal
(RCT)and by this Court. The plea raised by the landlord that he had sought enhancement of rent was not considered in the correct perspective shall also be a matter ofconcerned before the ARC on an appropriate application to be filed by the landlord.Parties are directed to appearbeforethe concerned ARC on 14.03.20|l6.
