Sonu @ Amarjeet v. State

1. The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking quashing of FIR No.0977/2015, under Sections 408/506 IPC, registered at Police Station- Narela, Delhi and the proceedings emanating therefrom. 2016:DHC:1507-DB

The facts in brief are that the subject FIR came to be registered on an allegation made by the complainant Rajesh Kumar Aggarwal (respondent No.2) that his employee Sonu @ Amarjeet (petitioner herein) who had been engaged to supervise a Gaushala owned by him, was not permitting him to enter the Gaushala and extending threats to him in that behalf.

Counsel for the parties, on instructions from the parties, who are present in person in Court and have been identified by the IO ASI Ramesh Chand, Police Station- Narela, state that with the intervention and help of respectable persons of the society, the dispute has been amicably resolved. Rajesh Kumar Aggarwal, the complainant herein, has now recovered possession of Shri Krishna Gaushala (subsequently named as ‘Shri Ram Gaushala’ by the petitioner herein) owned by him as well as the subject vehicle.

In view of the foregoing, since the dispute which resulted in the registration of the subject FIR has already been resolved amicably by the parties without any undue influence, pressure or coercion, no useful purpose will be served by proceeding with the subject FIR and the proceedings arising therefrom.

5. Consequently, FIR No.0977/2015, under Sections 408/506 IPC, registered at Police Station- Narela, Delhi and the proceedings emanating therefrom are hereby set aside and quashed qua the petitioner.

6. The writ petition is disposed of accordingly.

7. No costs.
