ORDER
1. Principal issue concerns interest entries debited to the account of Gopal Krishan Bhasin and M/s GABS, a partnership firm. Two original applications were disposed of together one concerning a credit facility and the other a housing loan. Interest concerning the housing loan would presumably be merged in the equated monthly instalments. Pertaining to the fV.F. (C) 11630/2015 &W.P.(C) 12197/2015 page 1of[2] 2016:DHC:9006-DB / / credit facility the interest would vary depending upon the extent of credit availed from time to time.
2. A sub-issue arises with respect to a sum of ^71 lacs paid by the petitioners requiring bifurcation ofthe amount paid for adjustment ofdues of the bank in the two accounts.
3. As we proceed tohear arguments we find pleadings non-focused with respect to the material particulars. Needless to state the material particulars have to be highlighting the debit entries inthe two accounts concerning the interest charged by the bank with reference to the Reserve Bank of India's instructions pursuant whereto rate ofinterest varied. Itis known to one and all that as and when Reserve Bank of India changes the prime lending rate interest the banks do so. Similarly whenever cash liquidate ratio or basic points are altered by the Reserve Bank ofIndia the banking industry usually changes the rates of interest.
4. Lest the two writ petitions suffer dismissal on technical grounds we permit the petitions to be withdrawn with liberty granted to the petitioner to lay challenge to the impugned orders by making specific pleadings. A pleading sans material particulars isnopleading intheeyes of law.
