JUDGMENT

1. The present matter has been reflected in the regular cause list since 03.2.2016. When the case was listed on 19.2.2016, Dr. Ashwani Bhardwaj was requested to give a written intimation of the pendency of the case to Mr. S.C. Sagar, learned counsel for the petitioner.

2. On 3.3.2016, at the request of the counsel for the respondents, the case was directed to be listed in the category of ‘regular matters’, in the week commencing from 08.3.2016.

3. Today, Dr. Ashwani Bhardwaj, learned counsel for the respondents submits that he had telephonically informed Mr. S.C. Sagar, counsel for the petitioner about the pendency of the present case and he had in turn stated that the petitioner has expired and the pensionary benefits have already been given to his family. It is submitted that perhaps it is for this reason that none 2016:DHC:2022 WP(C) 16611/2006 is present on behalf of the petitioner.

4. It appears that the petitioner is not interested in prosecuting the present petition any further which is accordingly dismissed in default and for non-prosecution. HIMA KOHLI, J SUNIL GAUR, J MARCH 09, 2016 ap
