Vinod Kumar Sharma v. Geeta Khurana

1. After hearing arguments for some time, learned counsel for the petitioner submits that as per instructions, petitioner is ready to clear the entire outstanding balance decretal amount of Rs.4,10,705/- on or before 06.06.2025. He also submits that in order to show his bonafide, he has also brought two Demand Drafts, totaling Rs.2,00,000/-, drawn in the name of Decree Holder Ms. Geeta Khurana.

2. There is no appearance from the side of respondent/Decree Holder despite advance notice being sent through WhatsApp.

3. This Court has gone through the impugned order dated 03.05.2025 which indicates that keeping in mind the conduct of the Judgment Debtor, the learned Executing Court has not given any further relief or respite to him and has directed issuance of warrants against him. CM(M) 987/2025 2

4. In view of the above assurance given by learned counsel for petitioner/Judgment Debtor and also by petitioner/Judgment Debtor, who is present in Court in person, the present petition is disposed of with the following directions:-

(i) The Judgment Debtor would appear before the learned

Executing Court on 28.05.2025 and would submit the abovesaid two Demand Drafts towards part realization of the balance decretal amount.

(ii) After deducting the aforesaid amount of Rs.2,00,000/-, the balance decretal amount, as per the latest report of the concerned Nazir of the Court, shall be cleared by the Judgment Debtor on or before 06.06.2025.

(iii) In order to enable the Judgment Debtor to clear the decretal amount on or before 06.06.2025, the coercive process i.e. warrants of arrest/warrants of attachment shall remain in abeyance.

(iv) Judgment Debtor would not be permitted to seek any further extension for making payment of balance decretal amount.

5. The petition stands disposed of in aforesaid terms.

6. Pending application also stands disposed of.

7. Copy of the order be given dasti under the signatures of Court Master.
