21.04.2016 The present are applications under Section 438 of the Code of Criminal
Procedure, 1973, seeking anticipatory bail in FIR No.88/2016 under Sections
392/397/34IPC registered at Police Station- Jahangir Puri, Delhi.
Mr Nayak, learned APP, on instructions from the 10 in the subject FIR, namely. Inspector Ajay Kumar, PS- Jahangir Puri, states that the applicants have sincejoined investigation and are co-operating with the police.
The complainant in the subject FIR, who is present in court today, has reiterated the assertion made by him on the last date ofhearing, i.e., 02.03.2016 in Bail Application No.380/2016, before this court that the allegations levelled against the applicants are aconsequence ofasudden quarrel related to amoney transaction betweenthe partieswho are knownto each other.
2016:DHC:8241 In view of the foregoing, the present applications are allowed. In the eventofthetrarresttheapplicantsshallbereleasedonbailontheirfurnishing a personal bondm the sumofRs.20,000/. eachwithtwosuretyofthelikeamount eachtothe satisfactionofthearrestingofficer/StationHouseInchargesubjectto the further conditions:
(i) That they shall continue to co-operate with the investigation and make themselves available for questioning to aPolice Officer as and when called upon todo so.
(ii) That they shall not try and influence witnesses or approach the complainant or tamper with the evidence in the subject FIR.
(iii) That they shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts ofthe present case so as to dissuade them from disclosing such facts to the Court or to any other authority.
(iv) That they shall appear before the court ofcompetent jurisdiction as and when directed to do so.
The applications are disposed ofaccordingly.
