VERSUS

JUSTICE RAJIV SAHAI ENDLAW ORDER % 06.05.2016

1. The appeal impugns a judgment and money decree.

2. Notice of the appeal was issued and subject to the appellant depositing the entire decretal amount in this Court execution stayed. Upon the decretal amount being not deposited, vide last order the stay of execution was vacated and since the respondent had remained unserved fresh notice was ordered to be issued to the respondent.

3. Though the respondent is reported to have been served but neither the counsel for the respondent/decree holder appears nor the counsel for the appellant appears.

4. It appears that the decree has been executed and the parties are left with no interest in the matter.
