Nagraj v. Harjeetsemgh

1. This order is in continuation ofthe orders dated 22"''March,2016,7^^ W' April,2016and 26"^April,2016.

2. Though the appellant and the respondent are present but the counsel fortherespondentstatesthatthe person/s before whom therespondentwants the appellant to apologise are not willing to come to this Court to hear the apology ofthe appellant.

3. Though the counsel for the appellant suggests that a direction enforcing the presence ofsuch person/s before this Court be issued but the said person/s being not parties to this /w, it is not deemed appropriate to make such an order.

4. It is thus deemed appropriate to separately record the apology ofthe appellant and halfa dozen copies ofthis order along with the statement of the appellant be supplied to the counsel for the respondent under signatures ofthe Court Master for distribution by the respondent to whomsoever the respondent desires.

Accordingly, the judgment and decree dated 11^'' July, 2014 of the Court ofAdditional District Judge,Central-9,Delhi ofdismissal ofcivil suit No.245/2013 bearing Unique Case ID No.02401C0407952012 filed by the appellantfor specific performance is modified by passing a decree in favour of the appellant and against the respondent in the sum of Rs.1,50,000/payable by the respondent to the appellant in equal monthly instalments commencing from the month of June, 2016 and ending in the month of January,2017.
