1. Counsels for the petitioners state that some of the petitioners herein had laid a challenge to the vires of Section 18 of the Immoral Traffic (Prevention) Act, 1956 and the said petitions are pending consideration before the Division Bench. They submit that the said W.P.(CRL) 962/2013 and connected matters 2016:DHC:9066 M petitions were listed before the Division Bench today and have been adjourned to 07.11.2013.
2. in view of the aforesaid submission, list the present petitions on 16'" January, 2014 to await the decision of the Division Bench.

1. The prayer in the writ petition, that is, W.P.(Crl.) No.962/2013 is for quashing ofthe order under Section 18 ofthe Immoral Traffic (Prevention) CRL.A. 1026/2013 and W.P.(CRL) 962/2013 til Act, 1956 (in short 'ITP Act') passed on the order on sentence dated 6 June, 2013 in Sessions Case No.77/12 arising out of case FIR No.136/09 and directions not to carry out forcible eviction ofthe petitioner.
3. When the petition came up for hearing before this Court on 7 June, 2013, the vires of Section 18 of the ITP Act was under challenge in a writ petition. The said writ petition has been decided by the Division Bench of this Court in the decision reported as 226 (2016) DLT 457 (DB) Nitu & Ors. vs. Govt. of NCT of Delhi & Ors. The Division Bench has upheld the constitutional validity of Section 18 ofthe ITP Act.
4. In view of the judgment of the Division Bench in Nitu & Ors. (supra) wherein the constitutional validity of Section 18 of the ITP Act has been upheld, which is also challenged in the present writ petition also, writ petition and the application are dismissed. CRL.A. 1026/2013 and CrI.M.B.No.3293/2015 At request of learned counsel for the appellant matter be retained on the Board.
