Learned counsel appearing on behalf of the applicants states that if this
Court were to grant protection to Hemlata, the applicant in Bail Application
No.997/2016, who isthe Jethani ofthe deceased/victim and has a three year old child, interim protection, all the other accused in the subject FIR, who are at large, would surrender before the SHO Police Station- Chhawla, during the
2016:DHC:8252 course ofthe day tomorrow.
This submission made on behalf of Hemlata, Jethani of the deceased/victim, the applicant in Bail Application No.997/2016, is not opposed by Mr. Ashish Dutta, learned APP appearing on behalfofthe police as well as
Mr. Naresh C. Sharma, learned counsel appearing on behalfofthe complainant, on humanitarian grounds.
Directed accordingly.
The protection afforded to Hemlata on humanitarian grounds, as aforementioned, is specifically subject to the undertaking fiimished on behalfof her counsel and further subject to her joining investigation and making herself available for questioning to the 10 in the subject FIR on reasonable notice, as and when required todo so, inaccordance with law.
The undertaking given on behalf of counsel hereinabove, is on specific instructions from Dinesh, the brother ofthe father-in-law, who is a co-accused in the subject FIR, as well as on behalf of Rakesh, Jeth ofthe deceased/victim, the applicant in Bail Application No.1001/2016.
Learned counsel appearing on behalf of the applicant Rakesh in Bail
Application No.1001/2016, therefore, seeks leave to withdraw the said application. Accordingly, the Bail Application No.1001/2016 filed on behalfof
Rakesh isdismissed as withdrawn. Pending application also stands disposed of.
