JUDGMENT
1. The petitioners have sought quashing of FIR No.59/2025 of PS Maidan Garhi for offences under Section 110/3(5) of BNS. The allegation against the petitioners is that on 11.01.2025, at about 08:30am, they stopped the complainant de facto on the way and assaulted him with bricks, stones and dandas, causing him multiple bodily injuries, though fortunately the injuries were not grievous. I have examined the MLC as well as two reports of radiologist.
2. The petitioners as well as complainant de facto (respondent no.2) are present in court, identified by their respective counsel and the Investigating Officer/SI Pardeep Kumar. It is submitted by all present that they have GIRISH KATHPALIA KATHPALIA Date: 2025.05.27 14:11:59 +05'30' CRL.M.C. 3021/2025 pages compromised the disputes. The respondent no.2 submits that he does not wish to pursue prosecution of the petitioners.
3. Further, it is informed by learned counsel for petitioners that against the present respondent no.2 also a cross FIR was registered for similar offences and the petition for quashing the same is already listed before another bench.
4. Keeping in mind the above circumstances and also the manner in which the two groups assaulted each other, creating serious law and order issues, the present petition is allowed subject to costs of Rs.10,000/- to be deposited by each of the petitioners with DHCLSC within one week and the FIR No.59/2025 of PS Maidan Garhi for offences under Section 110/3(5) of BNS and the proceedings arising out of the same are quashed. Pending application also stands disposed of.
5. It is made clear that if the said costs is not deposited by all or any of the petitioners and costs receipt is not placed on record after supplying advance copy to the Investigating Officer, the FIR and further investigation shall continue. (JUDGE) MAY 27, 2025
