(ORAL)

1. Petitioners seek quashing of inquiry being conducted by PS Mayur Vihar on complaint dated 20.04.2025 filed by respondent no.2. It is contended by learned senior counsel for petitioners that the complaint under reference has been filed only to arm twist the petitioners, who have initiated arbitration proceedings.

2. Learned ASC accepts notice and submits on instructions of Inspector Manoj Kumar from PS Mayur Vihar that what is being conducted is only an KATHPALIA Date: 2025.06.13 18:05:03 +05'30' W.P.(CRL) 1911/2025 pages inquiry and till date no FIR has been registered.

3. Learned senior counsel for petitioners submits that the petitioners apprehend that FIR for offences under SC/ST Act would be registered overnight and the petitioners would get no opportunity to even apply for anticipatory bail in accordance with provisions of the said Act.

4. Learned ASC on instructions submits that in case the inquiry leads to a view that FIR has to be registered, the petitioners would be given notice of one week before registering the FIR, so that petitioners may take appropriate recourse to law.

5. In view of the above assurance given on behalf of State, learned senior counsel for petitioners on instructions of briefing counsel seeks permission to withdraw this petition. The State shall abide by the assurance given today in court.

6. The petition as well as the pending application stand disposed of as withdrawn.
