Mr Malik, learned counsel appearing on behalf ofthe appellant, invites my attention to the Memorandum ofUnderstanding(MOU)dated 26.07.2016,a copy ofwhich has been annexed to the present application under Order 23 Rule
ORDER
3 CPC to urge thatthe subject matter has been amicably compromised between the partiesto the present appeal. The said MOU dated 26.07.2016 is attached to this order as Ex.C-1. A perusal ofthe same reveals that the same is lawful and it is,therefore. 2016:DHC:9321 accepted. Parties are now direeted to abide with the terms and conditions ofthe said MOU dated 26.07.2016 without demur and perform their reeiprocal obligations thereunder. The trial court is directed to release FDR No.014800PR00100233 dated 14.03.2009 in the sum of Rs.5,00,000/- deposited in case bearing CS No.257/2007(Suit No.107/11), along with interest accrued thereon, to the respondent Nand Lai in aecordance with law forthwith. Registry is directed to process the refund ofcourt fees in accordance with the provisions of Section 16A of the Court-Fees Act, 1870 as applicable to Delhi. With the above direction the appeals are disposed of as having been compromised.
