1. This petition by way ofPublic Interest Litigation has been filed with a prayer to direct the respondents to demolish the old/hazardous bore-well existing on the footpath of DDA land adjacent Jatav Basti, Village Tekhand(opposite side Prime Tower F-79/80)Okhia,Phase-1,New Delhi.

2. We have the learned counsel for the petitioner, who has submitted that the petitioner had in fact made a representation to the respondents on 15.06.2016 bringing to their notice about the hazardous bore-well. It is submitted that the respondents failed to take any action.

3. In the facts and circumstances, we dispose ofthe writ petition with a direction to the respondent Nos.I to 3 to look into the issues raised by the petitioner treating the writ petition as a representation and take appropriate action following due process oflaw ifthe averments in the writ petition are fV.P.fCJ 7034/2016 Page I of[2] 2016:DHC:8814-DB found to be true. The action taken shall be communicated to the petitioner within four weeks from today.

4. It is open to the petitioner to file a fresh writ petition in case necessity thereofarises.
