JUDGMENT
1. The Judgment Debtor No.1 has filed its objections to the present petition.
2. Appearance is entered on behalf of the Judgment Debtor No.2, who states that the present petition is liable to be transferred to the competent court vested with the territorial jurisdiction in view of the fact the properties mentioned in the Schedule, attached with the present petition, are mostly situated in Maharashtra.
3. Counsel for the Decree Holder states that some of the properties mentioned in the said Schedule are situated in the States of Karnataka and Madhya Pradesh. However, he requests that the present petition may be transferred to the District Court at Mumbai, Maharashtra for execution of the Judgment and Decree in question. 2016:DHC:5719 Ex.P.-472/2014
4. The Registry is directed to issue a transfer certificate to the Decree Holder for it to present its case before the appropriate court having territorial jurisdiction at Mumbai, Maharashtra, for further proceedings.
5. The parties shall appear before the competent court on 20th September, 2016.
6. The Judgment Debtor No.2, who is represented through counsel today, shall ensure his presence on the date fixed.
