ORDER
1. Delhi Sikh Gurudwara Management Committee, a body constituted under the provisions of Delhi Sikh Gurudwara Act, 1971 filed this writ petition by way of public interest litigation with a prayer to restrain the respondents from releasing the movie, namely, "A Flying Jatt" and further to C direct the respondent Nos.l and 2 to cancel the certification granted to the saidmovie under theprovisions oftheCinematograph Act, 1952.
2. It is alleged in the petition that the said movie has been made by the respondent Nos.[3] to 5 with aconcept based on the Sikh Tenets insulting and outraging the sentiments of the Sikh religion. It is also alleged that the movie contained the pictorial depiction of KHANDA (a Sikh religious symbol) and rendition ofwords from GURBANI in a disrespectful manner hurting and insulting the religious sentiments ofthe Sikh community. The grievance ofthe petitioner is that though several representations have been made from time to time, bringing to the notice of the respondent No.2 of W.P.(C) 7457/2016 Page 1of[2] 2016:DHC:8938-DB said facts dnd requesting to remove the objectionable parts/contents from the said movie, no action has been taken and the movie is now scheduled to be released on 25.08.2016.
3. We have heard Sh.A.P.S.Ahluwalia, the learned Senior Counsel appearing'for the petitioner and Sh.Sanjay Jain, the learned ASG for the respondent No. 1.
4. As could be seen from the Annexures P-4 and P-6 of the writ petition, i.e., representations dated03.08.2016 and 12.08.2016, the petitioner has already brought to the notice of the respondent No.2/Central Board of Film Certification about the alleged o^ectionable parts of the movie. We, therefore, deem it appropriate to direct the respondent No.2 to consider the said representations/objections and pass an appropriate order in accordance with law.
5. Having regard to the fact that the movie is scheduled to be released on 25.08.2016, we direct that such decision shall be taken by the respondent No.2 on or before 24.08.2016 without fail.
6. The petitioners are at liberty to appear before the respondent No.2/Central Board of Film Certification and make oral submissions, if so desire.
7. Writ petition is accordingly disposed of
