JUDGMENT

1. The instant appeal has been preferred by the victim – Suraj Singh @ Sunny under Section 372 Cr.P.C. for enhancement of sentence awarded to Respondents No.2 & 3. It is contested by the respondents.

2. During the course of arguments, respondents No.2 & 3 volunteered to pay `20,000/- more as compensation to the victim / appellant. The appellant has opted not to press the appeal for enhancement of sentence in view of it. `5,000/- (in cash) has been given by the respondents to the appellant in person present before the Court. Remaining amount of 2016:DHC:6208 Crl.A.476/2014 `15,000/- shall be paid to the appellant through the Investigating Officer within a month.

3. The appellant shall be at liberty to withdraw the compensation awarded by the Trial Court.

4. Since the appellant has opted not to proceed with the appeal preferred by him for enhancement of sentence in view of the settlement arrived at above, the appeal is disposed of as settled.

5. Trial Court record be sent back forthwith with the copy of the order.
