ORDER
1. The petitioners seek anticipatory bail under Section 438 Cr.P.C. in case FIR No.1323/2014 registered under Sections 420/120B IPG at PS Mehrauli.Status report is on record.
2. I have heard the learned counsel for the parties and have examined the file. By an order dated 21.08.2015, the protection granted by the Trial Courtto the petitioners fortwo weeks was BAILAPPLN.1698/2015&1700/2015 page[1] of[2] 2016:DHC:8314 extended till the next date of hearing by this Court. This protection was extended from time to time.
3. None has appeared on behalf ofthe complainant. So was the position on the previous dates of hearing. Learned counsel for the petitioners has placed on record the copy of the order dated 13.01.2016 of learned District & Sessions Judge (South) in Bail Application No.3922/2015 whereby co-accused V.M.Trehan has been admitted to bail on paymentof?1.70 crores to the complainant.
4. Learned counsel for the petitioners states that main accused has since been granted regular bail by the Trial Court and the complainant has been paid^178 crores towards alleged cheated amount. Learned APP,on instructions from the Investigating Officer,confirms it.
5. It is informed that the matter has been settled with the complainant.
6. Considering the facts and circumstances ofthe case and the role assigned to the petitioners, they are granted anticipatory bail and in the event of arrest, they be released on furnishing personal bonds in the sum of^ 50,000/- with one surety each in the like amount to the satisfaction of the SHO/Investigating officer. They shall, however, join the investigation as and when required.
