He submits that the adjudicating authority shall give a fresh hearing to the petitioner and thereafter pass a reasoned order after considering all the pleas of the petitioner, including the plea that the issue already stands concluded by a decision of this Court in
LPA No.117/2009 decided on 26.03.2009 titled Union of India & Others Vs.
City Bank, N.A.
Accordingly, the impugned order is quashed and set aside. The
2016:DHC:9125 petitioner shall appear before the adjudicating authority for a fresh hearing on 27.09.2016 at 11:00 a.m.
The petitions stand disposed of.
