Learned counsel for contesting respondents No. 1 to 3 submits that this appeal is liable to be dismissed on the ground that appellant No.l-
Ram Lai Yadav had expired in August,20,15 and his legal heirs have not been brought on record.
It is pointed out that on the ground ofconcealment ofthe fact that this property has been sold by appellant No.l to third party, this appeal deserves to be dismissed.
Since none appears on behalfofappellant even on the second call, therefore,this appeal and the application are dismissed in default.
