JUDGMENT

1. The present application has been filed by the appellant stating inter alia that during the pendency of the appeal, the parties had appeared before a retired Judge of the Allahabad High Court who was appointed by the respondent/company as an Ombudsman to mediate a settlement between them and pursuant thereto, the respondent/company has agreed to pay a sum of Rs.[5] lacs to the appellant in full and final settlement of all the claims, subject matter of Suit No.84/2010, from which the present appeal has arisen.

2. A pay order bearing No.597183 dated 05.08.2016 for a sum of Rs.[5] lacs drawn on HSBC Bank in favour of the appellant has been received by the Mr. Avinash Chaturvedi and Mr. B.K. Chaturvedi, Directors of the 2016:DHC:6680 RFA 218/2013 appellant, who state that now nothing further survives for adjudication in the present appeal, which may be permitted to be withdrawn.

3. The present appeal is dismissed as withdrawn in view of the settlement arrived at between the parties and recorded in the Settlement Deed dated 09.07.2016, executed between the parties (Annexure A[1]).
