1. The appellant has challenged the impugned awards on the limited ground insofar as the Claims Tribunal has granted recovery rights to ICICI Lombard General Insurance Company Limited to recover the award amounts from the appellant on the ground that there was no valid permit.

2. Learned counsel for the appellant submits that the appellant had a valid permit at the time of the accident. The copy of the permit was filed along with these appeals and vide order dated 4th April, 2016, this Court directed the ICICI Lombard General Insurance Company Limited to verify the genuineness of the permit placed on record by the appellant.

3. Learned counsel for ICICI Lombard General Insurance Company Limited submits that the verification report has been received and as per the said report, the appellant had a valid permit on the date of the accident.

4. In that view of the matter, the recovery rights granted to the ICICI Lombard General Insurance Company Limited to recover the award amounts from the appellant are liable to be set aside.

5. The appeals are allowed and the recovery rights granted by the Claims Tribunal to ICICI Lombard General Insurance Company Limited to recover the award amounts from the appellant are set aside. However, the awards passed by the Claims Tribunal directing the ICICI Lombard General Insurance Company Limited to pay the award amounts to the claimants are upheld.

6. The ICICI Lombard General Insurance Company Limited shall withdraw the executions filed against the appellant to recover the award amounts within four weeks.

7. The statutory amount be refunded back to the appellant.
