1. These are petitions filed under SectioI[1] 11 of the Arbitration and. Conciliation Act, 1996 (hereafter the 'Ad') for appointment of an, i I Arbitrator. The parties- had entered into~eparate agreements dates 19.06.2006 to set up an Air Separation Plant as well as for operation and maintenance of the said plant. It,is stated that the certain disputes have arisen in relation tothe said agreements.
2. The learned cout1sel for the parties sUbmit that the parties are agreeable to appoint Mr S. K. Dubey, Senior Advocate and a Former Judge,,, of the Madhya Pradesh High Court as the soH~ Arbitrator to resolve the, ' i disputes that have arisen out ofthe said agreemeqt.
3. Accordingly, it is propose to appoint Mr si K. Dubey as an Arbitrator. The Registry is also directed to communicate a ~opy of this order to Mr S.,, I
Arbitration and Conciliation Act, 1996. The parties are also 'at liberty to approach Mr S. K. Dubey for obtaining the requisite disclosure. 1. These are petitions filed under Section 11 of the Arbitration and Conciliation Act, 1996. (hereafter the 'Act') for appointment of an Arbitrator. The parties had entered into separate agreements dated 19.06.2006 to set up an Air Separation Plant as well as for operation and maintenance of the said plant. It is stated that certain disputes have arisen in relation to the said agreements. \./.. < s
2. By an order 19.09.2016, it was proposed to appoint Mr S. K. Dubey, Former Judge ofthe Madhya Pradesh High Court as a Sole Arbitrator.
3. The learned counsel for the parties state that Mr S. K. Dubey, Former Judge of the Madhya Pradesh High Court has made the necessary disclosure ~ under Section 12 ofthe Act, a copy of which is handed across. Accordingly, Mr S. K. Dubey is appointed as a Sole Arbitrator. The fee of the Arbitrator shall be in accordance with Schedule IV ofthe Act.
4. The petitions are disposed of.
5. Order dasti under the signature ofthe Court Master.
