20.10.2016 Petitioners have approached this Court by way ofpresent applications under Section 438 Cr.P.C. seeking anticipatory bail. Smt. Sunita is the mother of Ankit and Rohit. FIR No. 329/2016 under Sections
308/354/341/506/34 IPC has been registered at P.S. Mundka on the complaint ofMs.Sunita Kumari(sister-in-law ofpetitioner Smt.Sunita W/o
Sh. Surender Singh). In the FIR,complainant has alleged that her brother- in-law (jeth) was constructing a drain near the wall of her house, on 24^^
August, 2016, in the afternoon. Despite complainant's objection he continued construction. Accordingly,complainant was going to their house to advise them not to continue with construction, when Rohit and Ankit stopped her, abused her and gave beatings to her. Rohit threw her on the ground by catching hold of her breasts. When her husband Rajender intervened,he was also beaten. Ankitcaught hold ofher and gave a blow on her head by a pointed sharp object. Sunita w/o Surender also came there and gave beatings to her.
Learned counsel for the petitioners has contended that the husband of complainant is brother of husband ofpetitioner Sunita. They are living in the adjoining houses. On the day of incident, it is the complainant, her husband Rajender,her sister Urmila'and her sister's son Amit came to their house and quarrelled with petitioner Sunita and gave beatings to her.
Rajender,Sunita(complainant),Urmila and Amithad forcibly entered in the house and gave beatings to petitioner Sunita. Rajender threw Sunita on the ground by catching hold her breasts. Petitioner Ankit informed the police.
A cross FIR No.330/2016 under Sections 323/354/451/506/34IPG has been registered atP.S.Mundka on the complaint ofpetitioner Sunita. It is further submitted that complainant Sunita was discharged from the hospital on the next day. It is further pointed out that complainant Sunita is present in
Court. Incidenttook placetwo months ago.
Keeping in mind the above facts and circumstances,it is ordered that in case ofarrest, petitioners be released on anticipatory bail subject to their furnishing a personal bond in the sum of ^25,000/-(Rupees Twenty Five
Thousand Only) each with one surety each of the like amount to the satisfaction ofthe Investigation Officer/Arresting Officer/SHO concerned.
