Leaned Senior counsel for the petitioner prays for leave to withdraw the present petition with liberty to approach the appellate authority by an appeal under section 6 (F) ofthe Explosive Act, 1884.
Learned Senior counsel for petitioner submits that since it is Diwali season and the petitioner has been given licence for sale of fire crackers only till 01®^ of November, 2016, in case the appeal is not heard and decided by the Appellate Authority (i.e. Joint Commissioner (Licensing) today itself.
2016:DHC:8669 the entire matter wo^uld become infructuous and the petitioner who is an aged lady would suffer substantialfinancial loss. '
In view ofthe aboVe, the Writ Petition is dismissed as withdrawn with liberty to the" petitioner to file an appeal with the Appellate Authority. On the appeal being filed, the appellate authority shall hear and decide the appeal today itself If for any reason, the appeal cannot be taken up for disposal today, the Appellate Authority shall dispose of the same by 12
Noon tomorrow.
