JUDGMENT

1 Counselforthe appellanthasbroughttothe attention ofthisCourtthe orderdated 3.2.2014passed inSLP(Civil)No.810/2014by whichthisRSA 220/2013hasbeendisposed ofbyremittingthesuitfordecisiontothecivil court,andaswasdoneinanotherRSA 194/2013. Therefore,thisRSA will stand disposedofintermsoftheorderoftheSupremeCourtdated[3].2.2014.

2. Trial court and the appellate court records in this case be positively sent back within one week and parties to appear before the District and Sessions Judge(South West)Dwarka Courts, New Delhi on 21.11.2016. Registry willensurethattherecordsofthe trial eourtandthefirstappellate courtareavailabletothe Districtand SessionsJudgeonthedatefixed. 2016:DHC:9188

3. District and Sessions Judge will mark the suit file for disposal to a competent court in accordance with law if the suit is not already with the competent court of Civil Judge. Ifthe suit is already with the competent court ofCivil Judge then the suit file will be sent to the concerned court of Civil Judge.

4. The concerned court of the Civil Judge by whom the suit is to be decided will expedite the decision ofthe suit and preferably within a period ofsix monthsofthe receipt ofthe orderofthis Court.
