07.11.2016 Learned counsel for the petitioner corporation, on instructions, states that the corporation is agreeable to the following:
(i) The corporation will permit the respondents to join India Trade
Promotion Organization(ITPO).
(ii) The respondents would be entitled to retain their lien with the Delhi
Transport Corporation for a period ofone year and on or before the said date,the respondents would submittheir technicalresignations.
(iii) Cyan Prakash (respondent in W.P.(C) No.10347/2016 is in occupation ofstaff quarter. He shall vacate the staff quarter within
2016:DHC:8673-DB one month from the date hejoinsITPO on deputation.
Learned counsel for the respondents, on instructions, states that condition no.(iii) is acceptable to Gyan Prakash. With regard to condition no. (ii), it is submitted thatthe period ofprobation has not been specified by theITPO.
Learned counsel for the respondents states thatin caseITPO wantto extend' the period of probation beyond one year, the respondents will approach the petitioner corporation for appropriate orders.
Learned counsel for the petitioner corporation on instructions from Mr S.
Chandra,Depot Manager,has accepted the said suggestion.
In view of and recording the aforesaid statement, the writ petitions are disposed of.
The petitioner corporation would issue necessary orders / papers within a period ofone week from today.
Learned counsel for the respondents states that in view ofthe order passed today,he would not press the contempt petitions. The counsel for the respondents will file a copy ofthis order with theITPO.
