1. The petitioner is plaintiff before the learned Trial Court and has filed a suit for possession and damages.

2. The grievance of the petitioner/plaintiff is limited to the effect that despite the fact that the case has been fixed for plaintiff’s evidence, the defendant is trying to delay the recording of evidence by moving one application after the other.

3. The attention of the Court has been drawn towards various previous orders passed by the learned Trial Court in this regard starting w.e.f. 03.06.2024.

4. Learned counsel for respondent/defendant appears on advance notice and submits that there is no intention to delay the matter. He submits that one CM(M) 1165/2025 2 application moved under Order XVIII Rule 4 read with Order XIX Rule 3 CPC is pending adjudication.

5. When asked, learned counsel for respondent, in all fairness submitted that he would provide due cooperation and to the learned Trial Court so that there is no unnecessary delay in the matter.

6. The present petition is, accordingly, disposed of with request to learned Trial Court to consider the abovesaid application moved by defendant and to dispose of the same, as expeditiously as possible.

7. Needless to say, both the parties would render due assistance and cooperation in this regard.

8. The present petition is disposed of in aforesaid terms.

9. Pending applications, if any, stand disposed of.
