JUDGMENT

1. Learned counsel for the petitioner submits that the similar writ petitions bearing W.P.(C) 2478/2016, 4438/2016, 1077i/2016, 10772/2016 and 10774/2016 have been disposed of by this Court vide order dated 24."' November, 2016 by remanding back the matter to the Deputy Labour Commissioner. Learned counsel for the petitioner submits that similar order 2016:DHC:8868 be passed in these writ petitions as well.

2 Learned counsels for respondent no.l/workman have no objeoUon o this matter being remanded back to Deputy Labour Commissioner for reconciliation oftheamountpayablebythe petitionerto respondentno..

3. In the facts and circumstances of this case, the impugned recovery certificates are set aside and the matters are remanded back to the Deputy Labour Commissioner for reconciliation of the amount payable by the petitionertorespondentno.l. Thepetitionershallfilethecomputationalong with supporting documents including muster rolls beforethe Deputy Labour Commissioner within aperiod offour weelts from today with advance copy to respondent no.l who shall file his response thereto along with the documents in support thereofwithin aperiod ofthree weeks thereafter. The Deputy Labour Commissioner shall afford ahearing to both the parties and thereafter pass areasoned order determining the amount payable by the petitionerto respondentno.l. The copyoftheordershall be fiirnished to the petitioner as well as respondent no.l. The petitioner shall deposit the amount so determined by respondent no.2 within aperiod offour weeks of the date of receipt of the order failing which the Deputy Labom Commissionershall proceed to recoverthe same in accordance with law.

4. The Registrar General is directed to release the amount deposited by the petitioner in each case along with interest thereon to respective respondent no.l/workman, subject to final determination of the amount by Deputy Labour Commissioner.

5. The writ petitions and the pending applications are disposed of in the above terms.

6. Needless to say that if the parties are not satisfied with the fresh determination ofthe amount by Deputy Labour Commissioner, they would be at liberty to avail appropriate legal remedies available to them. # -J Jo
