JUDGMENT

1. Counsels for the parties jointly state that after the last date of hearing, the appellant and the respondent, who are brothers, held a meeting and with the intervention of their relatives and well wishers, they have been able to arrive at a settlement whereunder the appellant has agreed to pay a sum of Rs.1,80,000/- to the respondent in full and final settlement of the decretal amount, subject matter of the present appeal, and he has also undertaken that he shall handover the vacant peaceful possession of the suit premises to the respondent, on or before 15.1.2017.

2. Counsel for the respondent confirms that the terms and conditions of the settlement recorded herein above are correct.

3. Counsel for the appellant assures the court that the appellant shall adhere to the settlement arrived at with the respondent and he is already in the process of shifting from the suit premises. 2017:DHC:157 RFA 972/2016

4. Counsel for the appellant hands over a demand draft bearing No.503489 dated 9.1.2017 drawn on ICICI Bank, Darya Ganj, Delhi in the sum of Rs.1,80,000/- in favour of the respondent, to the counsel for the respondent, which is duly accepted by him.

5. In acknowledgement of the settlement arrived at between the parties and recorded hereinabove, counsel for the appellant and the appellant, who is present in person, as also learned counsel for the respondent shall affix their signatures on the margin of the order sheet.
