JUDGMENT

1. In view of the judgment dated December 23, 2016 the inevitable consequences has to be the RFA(OS) 62/2016 being allowed and RFA(OS) 69/2016 being dismissed.

2. We accordingly dispose of RFA(OS) 62/2016 setting aside the impugned decree awarding damages and costs against the appellant and in favour ofthe respondent.

3. The suit filed by the respondent is dismissed.

4. As regards RFA(OS) 69/2016 wherein the respondent seeks enhancement of damages the same is dismissed.
