JUDGMENT

1. Mr. Bhagvan Swarup Shukla, learned CGSC for the respondents, on instructions from Major Anish Muralidhar, Army, points out that the grievance in this petition is amenable to the jurisdiction of the Central Administrative Tribunal, in terms of Section 19 of the Administrative Tribunals Act, 1985, as the petitioners are civilians in defence services.

2. We find this submission to be correct in law. W.P.(C) 7341/2025

3. Keeping in mind the fact that the prayer is for compassionate appointment, and in order to avoid the petitioners having to re-file the matter, we transfer this writ petition to the Central Administrative Tribunal and we request the Tribunal to take up the matter on 9 July 2025, on which date the Counsel would appear before the Tribunal.

4. Ms. Supreet Kaur, learned Counsel for the petitioners undertakes that no adjournment would be sought on the said date.

5. Major Muralidhar also ensures that the respondents would be represented by a Counsel on the date when the matter is listed.

6. Accordingly, the writ petition is disposed of in the aforesaid terms without expressing any opinion on the merits of the case.
