JUDGMENT

1. Learned counsel for the appellant states that he does not wish to press this appeal as the appellant has arrived at an out of court settlement with the respondent. He hands over a copy of the Deed of Settlement dated 17.12.2016 executed between the appellant and the respondent, wherein the appellant/defendant has agreed to pay a sum of Rs.3,73,000/- to the respondent/plaintiff towards the satisfaction to the impugned judgment and decree.

2. Learned counsel for the appellant states that by now, the entire agreed amount has been tendered by the appellant to the respondent. He, therefore, does not wish to press the appeal. True copy of the Settlement Agreement has been taken on record.
