JUDGMENT

1. Appearance is entered by the counsel for the respondent, who states that he has received a complete set of the paper book and shall be filing his power of attorney within one week.

2. Counsel for the appellants/NrDMC points out that the respondent herein was also the respondent in RFA 715/2016, which was disposed of in terms of a consent order dated 01.12.2016, passed in RFA 786/2016, the lead matter in the connected appeals filed by the appellants/NrDMC.

3. Counsel for the respondent states that his client is willing to abide by the same terms and conditions of settlement as recorded in the consent order dated 01.12.2016. However, he requests that it may be indicated by the appellants/NrDMC as to what will be the estimated date on which the amounts payable to the respondent herein would be released in terms of the 2017:DHC:922 RFA 66/2017 compilation prepared and filed in the connected appeals that have been disposed of.

4. Counsel for the appellants/NrDMC states that he shall file an affidavit alongwith a brief compilation indicating inter alia, the amount payable and the estimated date of release of the payment to the respondent, in terms of the consent order dated 01.12.2016. The said affidavit shall be filed within one week with a copy to the counsel for the respondent.

5. The present appeal is disposed of alongwith the pending application in terms of the order dated 01.12.2016 passed in RFA 786/2016, while binding the appellants/NrDMC to the undertakings given therein. HIMA KOHLI, J FEBRUARY 15, 2017 rkb
