1. Learned counsel for the appellant states that the respondent had expired during the pendency of the appeal but before steps could be taken to bring on record his legal heirs, the appellant and the legal heirs of the deceased respondent have arrived at an out of court settlement. As a result, he does not wish to press the present appeal.

2. In view of the submission made by learned counsel for the appellant, the appeal is disposed of as not pressed.
