Allowed, subject to all just exceptions.
Application is disposed of.
W.P.(CRL) no. 791/2017 & Crl.M.A. No.4278/2017 (stay)
Petitioners and respondent no. 2 are neighbours. It is submitted that a quarrel took place between them on some trivial matter, which resulted in registration of the present FIR No. 342/2016 under Sections 325/34 IPC at
IC
Police Station Neb Sarai, on the complaint of respondent no. 2. With the
2017:DHC:8677 intervention of their common friends and family members, petitioners and respondent no. 2 have settled their disputes amicably. Respondent no. 2 is present in Court today and has been identified by ASI Sukhvinder Singh, P.S. Neb Sarai. Respondent no. 2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, coercion and pressure. He further submits that he is not willing to pursue the FIR any further and the same may be quashed.
Keeping in mind the fact that settlement has been arrived at between the petitioners and respondent no. 2 and that respondent no. 2 is riot willing to pursue the FIR any further, no fruitful purpose would be served to keep them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 342/2016 under Sections 325/34 IPC registered at Police
Station Neb Sarai and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
