JUDGMENT
1. The appellant has assailed an order dated 28.11.1990 passed by the learned Company Judge, allowing CA 4054/89 and dismissing CA 7570- 71/89 and CA 470/90. By the said order, the Administrator was directed to take complete charge of the Naya Bazar godown and the appellant was directed to hand over complete records, cash and other papers of the company to the Administrator. Further, the appellant was refrained from interfering in the conduct of the business of the company, namely, Northern India Goods Transport Co. (P) Ltd. Several other directions issued by the learned Company Judge have been set out at pages 38-40 of the paper book.
2. Counsels for the parties inform the Court that during the pendency of the present appeal, company petition bearing CP 89/69 was disposed of on 24.03.2005 and a Local Commissioner was appointed to submit a report 2017:DHC:1906 CO. APP. 3/1991 with regard to the shareholding pattern of the company, which report is under active consideration before the Company Judge and the said case is now listed on 31.05.2017.
3. In view of the fact that the Company Petition in which the impugned order was passed stands disposed of over a decade ago, nothing further survives for adjudication in the present appeal, which has unfortunately remained pending for several years only to bring on record the legal heirs of the deceased respondents No.4 and 5.
4. The present appeal is disposed of with liberty granted to the appellant to pursue the objections stated to have been filed by him to the report submitted by the Local Commissioner. HIMA KOHLI, J SANGITA DHINGRA SEHGAL, J APRIL 11, 2017 rkb
