1. Heard the learned counsel for the parties.

2. Leave granted.

3. We find that the High Court has not examined the role of Shri Bishwanath Raut @ Bishwanath Prasad. Therefore, we allow the appeal qua Bishwanath Raut. The High Court shall exmine Shri Bishwanath and shall take appropriate decision. So far as other parties are concerned, the order stands.

4. The High Court shall hear the parties on 15th January,

2016.
