JUDGMENT
(ORAL)

1. Petitioner seeks quashing of case FIR No. 699/22 of PS Uttam Nagar for the offence under Section 498A/406 IPC on the ground that he has compromised the matrimonial disputes with complainant de facto (respondent no.2).

2. As reflected from the record, the petition was firstly listed before this bench on 03.07.2025 and on that day, the petitioner handed over to respondent no.2 the full and final settlement amount of Rs. 1,50,000/- by way of a demand draft. Thereafter, statements of both the parties were recorded by the concerned Joint Registrar.

3. The petitioner as well as respondent no.2 have appeared through videoconferencing along with their respective counsel and they are identified by the IO/SI Bharat Singh present in courtroom.

4. I have spoken with the parties in Hindi and it is submitted by them that they have settled all their matrimonial disputes after getting their marriage dissolved by a decree of divorce. It is further submitted by them that they have only one daughter, whose custody shall remain with respondent no.2 and the visitation rights have been mutually granted to the petitioner. Towards full and final settlement, respondent no.2 has already received the entire amount and she submits that she has no objection if the present petition is allowed because she does not want to pursue the prosecution of the petitioner.

5. In view of the aforesaid, I am satisfied that it would be in the interest of justice not to push the parties through litigation. Therefore, the petition is allowed and FIR No. 699/22 of PS Uttam Nagar for the offence under Section 498A/406 IPC as well as proceedings arising out of the same are quashed.
