The appellanthas preferred the presentLetters Patent Appeal to assail the order dated 24.05.2017, whereby the appellant's application to seekpreponement ofthe date ofhearing ofC.M.(M) No. 423/2017 has been rejected.
The submission ofMr Saini, learned counsel for the appellant, IS that the first appeal, i.e., RCA No. 146/2000 preferred by the respondent is pending before learned Additional District Judge since

2010. Since the same was not disposed of, the appellant had preferred the aforesaid Civil Miscellaneous Main Petition to seek directions to the learned Appellate Court to expedite the disposal of the said appeal. However, the Civil Miscellaneous Main Petition itself has 2017:DHC:8886-DB now been adjourned to 04.08.2017. It IS hoped that Civil Misceilaneous Main Petition shall be heard and disposed ofby the learned Single Judge on the next date fixed inthe matter, sincethe Appellantonly seeks adirection by this Court under Article 227 of the Constitution of India to the First Appellate Courtto dispose ofthe longpendingRCA. It is made clear that pendency ofthe Civil Miscellaneous Main Petition before this Court shall not come in the way of the First Appellate Court in deciding the said appeal at the earliest.
